3:00 p.m. Preventing and Effectively Dealing with Workplace Violence

The specter of workplace violence is a concern for employers of all sizes. While only select instances receive wide attention, each year an average of nearly 2 million U.S. workers report having been a victim of workplace violence. A panel of experienced advisors and counsel will discuss what efforts can be taken to assess and reduce the risk of workplace violence, what plans should be in place for the immediate response to an incident, and how best to control repercussions to an employer following an instance of workplace violence.

4:00 p.m. The State of Cannabis in the Workplace (Joint Session with the Cannabis Committee Seminar)

For the past decade, the United States has experienced a “Green Wave” of states legalizing cannabis, resulting in 39 states and the District of Columbia legalizing cannabis for adult use, medicinal use, or both. This has greatly impacted employers in three areas: (1) employers governed by federal law, under which cannabis is still illegal; (2) accommodating medicinal use; and (3) how to address an employee’s off-duty use. This interactive session will be divided into three parts. First, there will be a brief overview of cannabis and THC and how they affect the human body. Second, we will focus on the states’ cannabis legislation and the conflict for employers that are governed in part under federal law but are in states that have legalized cannabis use. Finally, you will hear guidance and best practices for employers relating to drug testing and accommodating an employee’s cannabis use.

Important issues in developing the record can include motions in limine, objections during trial, motions for judgment as a matter of law, and objections to jury charges.
