Overcoming Thorny Hearsay Issues
This webcast will provide an overview of the fundamentals of the hearsay evidentiary rule—Federal Rule of Evidence 801. During the initial overview, the speaker will identify hearsay statements, analyze the impact of a declarant’s availability, cover the most frequently used exceptions to the hearsay rule, explain hearsay within hearsay problems, and clarify the foundational requirements for admitting hearsay as trial evidence. After the fundamentals overview, the speaker will focus on emerging and current hearsay issues pertaining to other similar incidents, governmental reports, child hearsay statements, co-conspirators, former testimony, and social media statements.
