    When a workplace injury or fatality involves a product, the actions of both the employer and the product manufacturer are often scrutinized. Workers’ compensation laws forbid most injured workers from suing their employers, but claims against manufacturers of products used in the workplace are common. Such claims often raise complex questions about interactions between the product, the workplace, and the workers. These questions can involve product design, usability, marketing, warnings, instructions, and maintenance requirements, as well as workplace safety management systems. This presentation will discuss how human factors professionals with expertise in occupational safety and health can evaluate the conduct of employers, workers, contractors, and product manufacturers in these contexts, including illustrative case studies involving industrial equipment, control software, and chemical products.

    This webinar will provide a basic overview of legal procedure regularly utilized by commercial litigators. The practice area of commercial litigation encompasses many different substantive areas of law but generally includes representation of businesses and businesspeople. There are certain strategic decisions that commercial litigators regularly need to make and tools that they routinely use throughout the litigation process. This includes venue and removal to federal court, enforcement of arbitration clauses, preservation of evidence and electronically stored information, taking and defending corporate witness depositions, responding to subpoenas, and protecting confidentiality and privilege. Experienced commercial litigators Maryan Alexander and Sarah Elizabeth Spencer will cover these protocols and offer some tips for best practices. The presentation is geared toward young lawyers who are starting their commercial litigation journey and experienced litigators who want a refresher.

    Last year, for the first time in many years, union representation rose in the private sector as well as the public sector. As a result, labor law under the National Labor Relations Act continues to be an important field of practice. It not only governs the right to form, join, and assist labor unions and labor-management relations such as collective bargaining, strikes, and boycotts but it also creates rights for even non-union employees. Because the National Labor Relations Board regulates through quasi-judicial decision making, the rules tend to shift with each new administration, and President Biden has promised to be very pro-union, which is expected to lead to more union activity and even greater protection for non-union employees.
