DRI President on NPR’s Marketplace: “Shortage of Trial Experience”

DRI president John Cuttino was interviewed by NPR reporter Sally Herships on August 4th for its Marketplace program. They discussed the growing problem of getting trial experience for young lawyers in an era when less than 3% of all civil cases actually go to trial. The vast majority of cases are either dropped or end in a settlement between parties.

Cuttino asserted that there is no substitute for experience. "In my 30 years of experience, no trial has gone according to script," he said. Birds have flown through the courtroom, lightening has struck. "It's a theater," he said. "Nothing is a substitute for the real event."
