By the time the jury is impaneled, the juror has seen billboards, television advertisements, and other media characterizing insurance companies in numerous ways. In this session, we will explore key developments in behavioral science and juror psychology and consider various litigation strategies to counteract conscious and unconscious biases impacting jurors in their decision-making process.

Microplastics, ultra-processed foods, hair relaxers – as the insurance industry faces these latest emerging, mass exposures, it can apply lessons learned from handling the last wave of mass exposures. We will discuss questions including, how are these newer matters different from the claims most recently addressed by the courts such as opioids, PFAS, firearms, and lead paint?
