Say Yes, Get Sued. Say No, Get Sued: Defending Municipal Data Center Decisions

Data centers have put municipalities in a no-win posture: approvals draw certiorari challenges, nuisance and takings claims, and open meetings suits, while denials and moratoria draw developer litigation and, increasingly, state preemption. This session walks through the claims now being filed against local governments on both sides of the decision, the records and procedures that determine whether those claims survive, and what defense counsel should be doing before the vote rather than after the complaint.

Christopher Smith, von Briesen & Roper, s.c., Milwaukee, WI

Managing Bad Faith Risk for Public Entity Claims

Bad faith claims are one of the most significant risks confronting insurers. This presentation will provide an overview of bad faith concepts and legal and regulatory requirements applicable to claims handling. It will also feature an interactive discussion of common bad faith scenarios and strategies for avoiding and navigating such exposure, as well as examining insurance coverage issues and concerns specific to the handling of public entity claims.
