Alternative Dispute Resolution
"You Can’t Handle the Truth," or Can You? Effective Use of Alternative Dispute Resolution (ADR) for resolution of Construction Disputes. The dispute resolution provisions of most construction contracts contain clauses requiring mediation and arbitration as opposed to litigation in state or federal court. ADR can be used by agreement of the parties in construction defect cases or in cases where the contract does not provide for ADR. This program will provide an overview of the various ADR options available for efficient resolution of construction disputes, including recommended best practices for preparing the dispute for the ADR process to obtain resolution either through early neutral evaluation, mediation, or arbitration.
