Employers are looking for advice about how they can increase diversity, equity, inclusion, and accessibility (DEIA) in the wake of last year’s Supreme Court decision about race-based affirmative action programs in college admissions, lawsuits challenging large law firms’ fellowship programs, and letters from state attorneys general to business leaders. In this program, Amalea Smirniotopoulos of the NAACP Legal Defense and Educational Fund, Inc. (LDF) will place the recent challenges into context with a discussion of relevant constitutional and statutory law and Edmund Brown of Pierson Ferdinand will share practical perspectives borne out of his experience leading his firm’s DEI efforts and advising employers to implement legally compliant DEI efforts.

9:15 a.m. Wage and Hour Update: Making Dollars and Sense out of the FLSA

The Department of Labor has issued two sets of regulations in the past year that have created a firestorm of controversy among business groups and Congress. The U.S. Department of Labor (DOL) has proposed raising the minimum salary required to qualify for the white-collar exemptions by over 50 percent. The DOL also proposed to revise its guidance on how to determine who is an employee or independent contractor under the FLSA. A Final Rule on the Independent Contractor regulations was issued on January 10, 2024. It is scheduled to go into effect on March 11, 2024. To address these thorny topics and more, we welcome back Ellen Kearns, the editor-in-chief for Bloomberg Law’s FLSA treatise, to guide us through these latest developments in the wage and hour field during this “can’t miss” session on a topic that we routinely address for our clients.

Since his appointment to the EEOC, Commissioner Keith Sonderling has led the Commission in focusing on the issues around Artificial Intelligence and Machine Learning in employment decision-making and human resources. As employment law practitioners we have some knowledge of the uses and discrimination risks of AI-driven technologies.
