DRI is proud to announce the 39th annual Civil Rights and Governmental Tort Liability Seminar in Orlando, Florida. Defending Protest Litigation - How Torres v. Madrid and seizure analysis has reshaped protest litigation

This presentation will introduce attendees to the variety of platforms law enforcement use in addressing crowd management during civil unrest and considerations in defending claims involving various uses of force. This session will address new trends, caselaw, anticipated Section 1983 claims that may be asserted, and the evolving considerations for defending such claims, as well as the scope of assistance expert witnesses may offer. This will include the development of shifts in Circuit Court analysis of Fourth Amendment claims involving the use of force in protests for reasons other than intent to restrain under the Supreme Court’s decision in Torres v. Madrid.

The Complete Guide on How to Handle a Sober Home Application for Government Entities

For public entities, handling sober home application requires balancing community interests with the federal Fair Housing Act (FHA) and Americans with Disabilities Act (ADA), which protect individuals in recovery from discrimination. Federal courts have consistently sided with sober homes when local governments attempt to impose discriminatory zoning restrictions. Therefore, a government's role is to ensure compliance with legitimate health and safety standards while providing "reasonable accommodations" to allow sober homes to operate in residential zones.
